2. Use of services
You can register on myPIX regardless of your age and should enter
your name, address and e-mail address
You commit to provide us with reliable and accurate information about
you, The services of myPIX are for private use only
The upload and hosting of your photos on an account are simple, as you
just have to identify yourself with your e-mail address and given password
at the time of registration,
Severa upload modes can be selected to download your photos in your albums,
The user shall ensure the images put online are in accordance with current
laws, especially sections about pornography, pedophiliae and intellectual
property laws,
myPIX has the right to report any breach in the legislation,
myPIX reserves the right not to put images - even if the images are
in accordance with the law - which have a violent, racist, pornographic
or pedophiliac nature,
myPIX may also refuse to produce prints from this type of images
Hereby you accept to compensate myPIX for any harm (including any compensation
that person may have to pay to third parties or any honoraries to support
his own defence) one could suffer due to the diffusion (i) of images communicated
to a third part, (ii) any violation of these General Terms and Conditions
(iii) or any illegal activity operated from your account, prior to any
fault or careless omission on your behalf.
3. How to place an order

The registration to myPIX is free of charge
Download the photos on your account thanks to the different upload modes
and order selected photos,
From a shared album
A third part can share his/her photo album with you so that you can visualize
or order them,
To order your photos from a shared album, you just have to choose the
selected photos and add them to your shopping cart,
From a CD
You can send your CDs containing your photos to process them to the following
address :

4. Data confidentiality
Important:
The acceptance of said general conditions involves the automatic subscription to the promotional newsletter.
You can opt out of subscription at any moment by clicking on the provided links.
The user's personal data are used to send him photo prints, contact the
person in case there is a problem with the order, and keep the former
informed of myPIX offers and services.
The information you give being essential for the processing, conveyance
and invoicing of orders;
their omission would entail the cancellation of your order. Whilst registering
on myPIX , you implicitly commit yourself to provide us with reliable
and accurate information about you.
The communication of false information is contrary to these General Terms
and Conditions of use.
In accordance with the "IT Rights" law (Data ProtectionAct),
the processing of your data has been registered to the National Data Processing
and Rights Board (NDRBl) (CNIL).
myPIX is authorised to withdraw, process and use personal information.

5. Intellectual property
Both contents of myPIX website and myPIX Photo Service programme
(texts, illustrations, encoding data system) are property of Pixmania,
partners, relevant users of the website and Pixmania legally-contracted.
Any partial or total reproduction of the content by any means on any support
shall be given specific authorization by myPIX .
Any transmitted images while ordering remain property of the user.
The user confirms full intellectual property -in accordance with current
laws- concerning the pictures transmitted to PIXmania with regards to
clauses of these General Terms and Conditions.
You shall undestand that myPIX cannot give you authorization to copy,
dipslay or disribute any contents for which you do not hold intellectual
property or copyright (herafter" Rights ").
All information, contents, files, softwares and equipment proposed by
our services are protected under french and international copyright laws
on intellectual property.
myPIX cannot be held responsible in case of a user's violation basic
Rights owned by third parts; or any activities perpetrated by the latter
on the website.
6. Liabilities
The user of the Site acknowledges to connect and use the services
of the Site at his own risk. The responsiblity of My Pixmania cannot be
taken concerning direct or indirect damage ( financial, benefits or luck
losses ), that a user or third part may experience during a login session
to the Site, or the incapacity to access or connect to the Site, and considering
also the non functionning or functionning of the site.
The damage that may arise from inaccurate contents, errors, slowness or
interruption during transmission, loss, disappearance or data alterations,
virus, whatever the origin, intrusion by third parts, and more generally
the use of the site or incapacity to use it are specifically mentionned
here.
myPIX guarantees to do anything in its power to ensure full availability
of myPIX . However, a temporary interruption of our services may
occur due to technical reasons.
myPIX will try its best to keep its customers updated on the nature
and duration of possible interruptions; but cannot be held liable for
the unavailability of its services. Likewise, myPIX cannot guarantee
reliability or quality of the Internet newtwork outside the Pixmania premises.
myPIX has a high-performance database saving system ( personal information,
images...). Even in case of severe breakdown, this system should allow
oneself to recover the integrality of received data.
However, myPIX cannot be held responsible in case of a loss of data,
and the user shall save a copy of the files. The processed images are
deleted from the myPIX server not later than 5 days after placing
an order.
In case of a loss or damaging of data, the responsibility of myPIX
is limited to a replacement of a new support of equivalent quality,
The user is the only liable person for communications and data downloaded
by him on the Site.
The existence of other links is designed for the user's conveniency. myPIX
cannot be held accountable for the content of these sites, and cannot
be held responsible in case the user has grievance to formulate to these
sites.

The price shown on the site is in euros and inclusive of taxes (delivery
costs not included), Delivery costs are chargeable to the user and billed
at the end of an order on top of all selected products,

will be charged with the price that showed on the site at the time of

Service Pack photos:
myPix gives you the chance to purchase different Photo Packs made up of a determined number of prints (number and size of photographs), shipping and processing fees, as well as indexes.
This Pack may be used on several orders and is valid for one year, with no minimum purchase necessary.
Once the Photo Pack has been purchased, no partial or total refund will be made by myPix regardless of whether the Pack has been partially used up or not.
The Photo Pack is strictly for personal use and may only be used by the User through the User Account on which it was purchased.
8. Delivery
Your order shall be delivered to the address you have provided or to the Pick Up Store if you chose this option,
The delivery times shown on the site are for your information only and may be modified,
myPIX cannot be held liable for any delay or loss of parcels that may occur whilst the parcel is with the courier.

You can collect your photos, frames, albums and personalised products directly from the PIXmania Pick Up Store in London.
Orders must be paid in advance online, no payment will be accepted at the Pick Up Store.
The delivery costs are £1.
You can collect your photos, frames, albums and personalised products directly over the counter without queuing.
An email and/or SMS shall be sent to you to confirm when your order is available for collection.
All orders must be collected from the Pick Up Store within 7 days.
After this period they shall no longer be kept by myPIX.
Please print out your invoice or confirmation email and bring this with you when you go to collect your order from the Pick Up Store.
No After Sales Service is available for myPIX at the Pick Up Store all queries should be addressed to the myPIX Customer Care Service.
Using this option you can collect your order directly from the Pick Up Store.
Delivery :
- Depending on the products orderd, you may receive your order in several different parcels.
9. Payment
You can pay with a credit card (Mastercard or Visa)
For any order paid with a credit card, your bank account is debited 4 days after authorization to withdraw money on your account in accordance with competent payment centres, This is valid for any orders above 1€, Your order will not be taken into account if this condition is not fulfilled.
For a credit card payment, it is done via the security system " Secure
Socket Layer " which operates the encryption of your bank details
once on the server,
In case of reimbursement, the user is refunded via his bank account in
case of a payment with a credit card
10. Discount codes
Promotional codes consistent with a trial offer (from our partners) or
appearing as such cannot be used in conjunction with another offer, except where indicated
or mentionned.
The codes are only valid on signaled items on our Site. A promotional
code corresponding to an offer can be used only once per household and
is not repayable. The promotional codes are not cumulative on the same
order.
In order to benefit from the reduction of the codes, it is essential to
mention the discount code while ordering on the phone, or quote it in
the appropriate field when ordering from our Site.
In case of an omission on your behalf, we will not cancel or renew the
order to take that promotion into account if the order has been processed
already. Promotional codes are valid only during certain times in magazines
and with our partners.
11. Exclusion of a user
and disconnection/interruption access to the site
myPIX reserves the right to exclude unilaterally - including by immediate
disconnection - any user in case of breach of these General Terms and
Conditions; or more generally in case of violation by the former on any
of these trade bonds.
Particularly, access codes provided to the user may be deactivated in
case the details, piece of information or documents given by him/her on
his/her situation are or have become inaccurate or more generally, if
the maintening of information or documents on line may be susceptible
to have bad consequences for myPIX or any other user of the website.
myPIX may disconnect a user and/or prevent access to the Site if
the loggin session entails or may entail breakdown in the system or difficulties
for other users, or in case of a breakdown, dysfunctionning or any potential
data processing risk.
myPIX reserves the right - if useful or necessary - to suspend the
site access, without being deprived from the right to receive remuneration, and if
the case arises, damage and interests.
The liability of myPIX will not be involved no matter what in the
following cases.
12. Complaints and cancellations
Should you wish to cancel your subscription with myPIX , please send

13. Applicable law -
Competent jurisdiction
The Site has been elaborated in accordance with current French laws.
Any dispute that may arise between PIXmania and a user will be submitted
to competent jurisdictions of Paris Court Law.
